Terms and Conditions

The service is in its final stages before launch, and these terms apply to your use of it as soon as it becomes available to you. By using the service you confirm that you have read and accepted these terms. The Arabic version prevails if it differs from this English translation.
Accepting these terms, eligibility, and your account
These terms are a binding agreement between you and [__] ("Lbbak", "we"). Please read them before using the service. If you do not agree to any part of them, do not use the service.
To use the service you must be at least eighteen years old, legally eligible to use payment services in Saudi Arabia, and hold a valid national ID or residency permit that can be verified through the Saudi national single sign-on (Nafath). You must register under your real name with accurate, complete information and keep it up to date. We may ask for additional information or documents to verify your identity or the source of funds, to meet know-your-customer and anti-money-laundering requirements, and may suspend the service until that is completed.
One account is allowed per person. You are responsible for keeping your login details confidential and for all activity carried out through your account, and you must notify us immediately if you suspect any unauthorized use.
Definitions
• Occasion (المناسبة): the event created in the app for collecting or sending monetary gifts, such as Eid, a wedding, a marriage-contract ceremony (milkah), a graduation, a new baby, or a congratulation.
• Organizer (المنظّم): the user who creates the occasion, sets its details and its recipient, and shares it with invitees.
• Invitee / participant (المدعو): the user who receives the occasion link and chooses to send a monetary gift through it.
• Gift (الهدية): the amount of money an invitee sends through the app within a specific occasion. It is a voluntary personal gift, not payment for goods or services.
How occasions and gifts work
The organizer creates an occasion in the app (Eid money, wedding or milkah gifts, congratulations, graduation, a new baby, and the like), sets its details and its recipient, then shares it with invitees through a link.
The invitee chooses the gift amount and is shown the gift value, the fee, and the net amount before confirming. Once payment is completed, the gift is recorded and directed to the recipient named in the occasion. The amount may take [__] to reach their account, depending on the procedures of payment providers and banks.
Lbbak is a technical intermediary that facilitates the transfer of a gift between users. We are not a bank, we do not take deposits, and we pay no return on any amount. Funds on their way to the recipient are held with [__: the entity holding the funds or the payment service provider]. [Regulatory status with the Saudi Central Bank — to be completed].
Lbbak is not a party to the relationship between the giver and the recipient. The app keeps an archived record of every occasion showing the participants, the amounts, and their dates, available to each user within the limits of their access.
Fees and VAT
Creating an account, organizing occasions, and inviting participants are free of charge.
A service fee of 2.5% of the value of the transferred gift applies, charged when the transfer is completed. [__: is the fee added on top of the gift for the giver, or deducted from the amount the recipient receives?] [__: is there a minimum or maximum value for a single gift?]
Fees and the net amount are shown clearly before you confirm any transaction, and we charge no fee that was not shown to you in advance. VAT is added to the fee where it is due under Saudi law.
Your bank or card issuer may charge its own fees, which are outside our control. If we change our fees, we will notify you [__] days before the change takes effect, and it will not apply to transactions completed before then.
Cancellations, refunds, and mistaken transfers
Before a transfer is completed you may cancel the gift within [__]. Once the transfer is completed the gift is final and cannot be withdrawn unilaterally.
If an occasion is cancelled or ends without the recipient collecting the amounts, the gifts collected are returned to their senders through the same payment method within [__] business days. [__: is the service fee refunded in this case, or deducted from the returned amount?]
If you send a gift for the wrong amount, or to the wrong occasion or recipient, tell us within [__]. We will make reasonable efforts to stop the transfer if it has not completed, or to contact the recipient and help arrange a return if it has. However, recovering an amount that has reached the recipient requires their agreement, and we cannot guarantee it.
For unauthorized transactions, or ones caused by a technical fault on our side, report them within [__] of the transaction date. We will investigate and return the amount to you where your claim is established. In all cases you may file a complaint through the complaints procedure published on the website.
Prohibited use
Lbbak is for personal, occasion-related monetary gifts only. The following are specifically prohibited:
• Fraud and deception: creating fake occasions, impersonating someone else, soliciting funds under false pretences, or using a payment method you do not own or are not entitled to use.
• Money laundering, terrorist financing, concealing the source of funds, or splitting amounts to evade verification thresholds. We are required to report any suspicion to the competent authorities under applicable law.
• Commercial use of the service, such as selling goods or services, or charitable fundraising or crowdfunding campaigns without authorization from the competent authority; and any use that breaches Saudi law, infringes the rights of others, or harms the integrity of the platform, such as hacking attempts, automated use, or reverse engineering.
Suspension, termination, and pending funds
You may close your account at any time, once any outstanding transactions or obligations have been settled.
We may restrict, suspend, or close your account if you breach these terms, if we suspect fraud or money laundering, if your identity cannot be verified, or where a legal requirement or an order from a competent authority applies. We will tell you the reason unless the law prevents us from doing so.
Pending funds are held during a review for no longer than [__], then released to the person entitled to them or returned to their senders, unless a competent authority requires otherwise.
After your account is closed we keep records of your transactions for the period required by law ([__]), as set out in the privacy policy. The provisions on fees owed, liability, and governing law continue to apply after closure.
Intellectual property and third-party services
All intellectual property rights in the app and website, including the Lbbak name, logo, designs, content, and software, belong to us or are licensed to us. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose only.
You may not copy, modify, or reverse engineer the app, or use the brand or any part of the content for commercial purposes, without our prior written consent.
You keep ownership of the content you enter, such as the occasion name, messages, and invitee lists, and grant us a limited licence to use it as far as necessary to operate the service. You are responsible for the lawfulness of that content and for being entitled to share the data of the people you invite.
The service relies on third parties, including Nafath for identity verification, payment service providers and banks to carry out transfers, and app stores to download and update the app. Those services are governed by their own providers' terms, their interruption may affect the availability of ours, and we are not responsible for their acts beyond our reasonable control.
Disclaimers and limitation of liability
We apply reasonable professional care in operating and securing the service, but we do not guarantee that it will run without interruption or error. We may pause it temporarily for maintenance or updates, and will give advance notice where possible.
We are not a party to the relationship between the organizer, the participants, and the recipient. We are not responsible for the reason behind an occasion, for the accuracy of what the organizer says about it, for how the recipient uses the money once received, or for personal disputes between users.
We do not exclude or limit our liability for fraud, gross negligence, or wilful misconduct on our part, nor any liability that Saudi law does not permit us to exclude. Otherwise, our liability is limited to direct, proven damage, up to a maximum of [__].
We are not liable for a failure caused by force majeure or circumstances beyond our reasonable control, such as the interruption of communication networks or payment systems, or decisions of competent authorities.
Changes to the service and these terms, complaints, and governing law
We may develop the service, add features, or discontinue some of them. If a change is material and affects your rights or obligations, we will notify you [__] days in advance through the app or your registered email.
We may update these terms and will publish the updated version on the website and in the app with the date of the last update. Continuing to use the service after an update takes effect counts as acceptance of it; if you do not agree, you may stop using the service and close your account.

These terms are governed by the laws of the Kingdom of Saudi Arabia, including the Personal Data Protection Law, the payments regulations, and the e-commerce law. Disputes that are not resolved amicably are heard before the competent Saudi courts or committees. If any provision of these terms is invalid or unenforceable, the remaining provisions stay in force.
